Those walls are quietly doing serious structural work. So a question comes up again and again for homeowners here: does my retaining wall need an engineer and a permit, or can I just build it? When does a retaining wall need an engineer and a permit?

A short garden border a foot or two high, holding back a flower bed, is a landscaping feature. A wall holding back the earth under your driveway, your neighbour's yard, or the slope below your house is a structure, and structures that fail can hurt people and property. The dividing line is mostly about height and load.

A common rule of thumb across BC municipalities is that a retaining wall over roughly 1.2 metres (about 4 feet) of exposed height typically requires a building permit and engineering. Several other situations can trigger engineering and a permit even below that height:

  • Tiered or stacked walls. Two shorter walls stepped up a slope can act like one tall wall if they are close together, and the combined load is what matters, not the height of each tier on its own.
  • Surcharged walls. A wall is "surcharged" when there is extra load pressing on the soil behind it, such as a driveway, a parked vehicle, a pool, a building, or a steeper slope rising above it. That added load changes the engineering even for a modest wall.
  • Walls near property lines, structures, or a watercourse. Setbacks and environmental rules can apply, especially on the creek-adjacent and hillside lots common in West Kelowna.

Two important cautions. First, these thresholds are general guidance, not the final word.
